The following information may be helpful to anyone who suffered a loss as a result of natural disasters.

♦  Disaster Remediation -- Important Statutory Requirement

  • HB1711 passed in 2011 by the Texas Legislature and is included in Chapter 58 of the Texas Business & Commerce Code.  The law applies to disaster remediation contractors, which is identified as those engaged in the removal, cleaning, sanitizing, demolition, reconstruction, or other treatment of improvements to real property performed because of damage or destruction to that property caused by a natural disaster. As tragic floods and other devastation subsides and the rebuilding begins, TAB members must be aware of the statutory contract limits on those who have not had a business address for at least one year in the county or adjoining county of the disaster. Ignoring these requirements could result in a deceptive trade practices violation.
